Terms of Service

Last updated: 12 October 2026

Welcome to Gotcha. These Terms are the agreement between you and us. By using the app, you agree to them. We've kept them plain and short.

Gotcha ("Gotcha", "we", "our", "us") operates the Gotcha mobile app and the gotcha.ing website (together, the "Services"), an independent product currently in beta and based in the United Kingdom. Contact: frank@gotcha.ing.

1. Who can use Gotcha

You must be 18 or over to use Gotcha. By using it, you confirm you are.

Gotcha is in beta. That means it's still being built — things may change, break, or disappear, and features come and go. Please don't rely on it for anything critical yet.

2. Your account

  • Sign up with a real email and phone number so we can verify you're a real person. One account per person.
  • Keep your login details safe. You're responsible for what happens on your account.
  • You can delete your account at any time from within the app.

3. The heart of Gotcha: honest reviews

Gotcha exists so people can share honest, first-hand opinions about places they've actually been. When you post, you agree that:

  • Your review is based on your own genuine experience.
  • You have not been paid or incentivised to write it.
  • It's your honest opinion — not a statement of fact you can't back up.
  • You'll keep it to your experience of the venue — not politics, personal attacks, or whatever's trending in the news.

Our promise back to you: we don't remove honest opinions

We will not take down a review just because a business dislikes it. A negative but honest review is exactly what Gotcha is for. Businesses can reply, but they cannot pay us to delete your honest opinion.

The limit: this promise covers honest opinion. It does not cover content that is unlawful — see the next section. We may remove that, and we may remove or edit a review if we're legally required to.

4. What you must not post

You agree not to post content that:

  • is false as a statement of fact and harms someone's reputation (defamatory);
  • is hateful, harassing, threatening, or discriminatory;
  • is illegal, or encourages illegal acts;
  • identifies or targets a private individual (reviews are about businesses, not people);
  • infringes someone else's copyright or privacy (only post photos you took);
  • is spam, fake, bot-generated, or part of a coordinated review attack;
  • contains someone's personal or sensitive data.

If you break these rules, we may remove the content, suspend, or delete your account.

5. Your content, and the licence you give us

You own your reviews and photos. You keep all rights to them.

To run Gotcha, you give us a non-exclusive, worldwide, royalty-free licence to host, display, and share your content within the app and its features (for example, showing your review on a venue's page, or in a link you share). This licence lasts as long as your content is on Gotcha and ends when you delete it — except for copies we must keep by law or that others have already shared.

6. How long reviews stay up

Honest reviews are meant to last — that's the point. We keep your reviews live while your account is open. If you delete a review or your account, it comes down (though people may have already shared or screenshotted it, which we can't control).

7. Reporting and moderation

If you see something that breaks these rules, use the report button. We review reports and act on them, prioritising anything unlawful or harmful. We aim to be fair and transparent, and we don't shadow-ban.

We're a small beta operation, so moderation won't be instant — but we take genuinely harmful content seriously.

8. Businesses on Gotcha

Venues appear on Gotcha so people can review them. A business being listed doesn't mean it endorses, or is affiliated with, Gotcha. Businesses can respond to reviews but cannot remove honest ones. If a business believes a review is unlawful (not merely unflattering), it can contact us at the email above.

9. The usual legal bits

  • Gotcha is provided "as is." Because it's a free beta, we don't make guarantees that it will be uninterrupted, bug-free, or that reviews are accurate — reviews are personal opinions, not our statements.
  • Reviews are opinions of their authors, not of Gotcha. We're a platform, not the author.
  • We're not liable for losses arising from your use of a free beta product, except where the law doesn't allow us to exclude liability (for example, death or personal injury caused by our negligence, or fraud). Nothing here removes rights you have as a consumer that can't be waived.
  • We can suspend or end the service, or your access, if you break these Terms or if we stop running the beta.

10. Changes, law, and contact

  • We may update these Terms as Gotcha develops. We'll change the date above and flag significant changes in the app.
  • These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
  • Questions, complaints, or legal notices: frank@gotcha.ing.
